BNO VISA 幾時開始計算 5 年居住時間?

 最近有粉絲查詢，BNO Visa 幾時開始計算 5 年居住時間，有人指是入境英國當天開始計算，但亦有人指是簽證獲批當日開始。誰是誰非，不如看一看官方說法。

The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period. Any absences between the date of issue and entry to the UK count towards the 180 days allowable absence in the continuous 12-month period. The applicant does not need to provide evidence to demonstrate the reason for delayed entry.

在簽證發出日至入境英國的時段可作為合資格時段。在簽證發出日至入境英國前的日子可計入離境不能超過 180 日的規定，申請人無須提供原因解釋為何延遲入境。

意思是獲批 BNO Visa 後，若你 180 日內入境英國，5 年居住期可以由簽證獲批當日開始計，例如你簽證在 2021 年 6 月 1 日獲批，你在 2021 年 11 月 1 日才入境，當中的 153 日是 qualifying period，五年居住規定可以由 2021 年 6 月 1 日起計。

If the delay is more than 180 days, you can only include time after the applicant entered the UK in the continuous period calculation.

若你遲過 180 日才入境英國，你只能由入境當日起計算連續 5 年居住期。

例如你 2021 年 6 月 1 日獲批簽證，但你在 2021 年 12 月 1 日才入境，當中有 183 日，超出了 180 日的規定，所以你會在 2021 年 12 月 1 日起開始計 5 年居住期。由於你的簽證會在 2026 年 5 月 31 日到期，但你到時還沒有在英國居住足夠日數，所以你必須申請延長簽證。

No more than 180 days’ absences are allowed in a consecutive 12-month period.

在連續 12 個月，你不能離開英國超過 180 日。

記得將 qualifiying period 的日子計算入 12 個月內不能離開英國超過 180 日的日數，例如你的簽證在 2021 年 6 月 1 日獲批，2021 年 11 月 1 日才入境，你已經有 153 日不在英國，所以在 2022年 5 月 31 日前，你不可以離開英國超過 27 日，否則會超過 180 日的規定。

You must only include whole days in this calculation. Part day absences, for example, less than 24 hours, are not counted. Therefore, if the applicant had a single absence during the 12 month period and arrived in the UK on day 181, the period would not exceed 180 days.

在計算離境英國日數時，同日部分時段不在英國不會計入不在英國日子，即是 24 小時內，有部分時間不在英國，當日不算是不在英國。因此，若申請人第 181 日才入境英國，當日會被當成在英國的日子，所以沒有超出 180 日的規定。

如果親身到簽證中心處理申請，你的 Visa Vignette 有效期只有 90 日，必須在 90 日內入境英國，否則需要申請延長 Vignette。

If your 90 day vignette has expired, you will need to apply for a replacement by completing the online form. The cost of replacing an expired 90 day vignette is £154 and you will need to make an appointment to resubmit your biometric information.

若你的 90 日 簽證貼過期，你須要填妥網上表格申請更換，費用 £154，你亦須預約到簽證中心重新提供生物識別資料。

TB Test 有效期為半年，若入境前你的 TB Test 已經過期，你必須再做 TB Test，有網友聯絡 UKVI，獲得以下答覆：

若你在入境時，你的肺結核檢測已經過期，你必須再進行另一次肺結核測試以供邊境人員核實。

在這 5 年間，若你在 12 個月的連續時段內沒有超過 180 日不在英國，你到第 6 年就有資格申請無限期居留 indefinite leave to remain，即是永久居民 permanent residence 資格。

️申請 BNO Visa 的最終目的是為了入籍，所以 5 年後你需要申請無限期居留，獲得無限期居留 1 年後，可申請歸化 naturalisation 成為英國公民 British citizen，但有以下居住條件：

The residence requirements which someone applying under section 6(1) of the British Nationality Act 1981 are that the applicant was:

• in the UK at the beginning of the period of 5 years ending with the date of the application
• not absent from the UK for more than either:
   - 450 days in that 5-year period
   - 90 days in the period of 12 months ending with the date of application

申請歸化成為英國公民的申請人必須符合 1981 年國籍法案第 6(1) 段的居住要求：

申請人提出申請歸化日的前 5 年身處英國；
在這 5 年期間，沒有離開英國超過 450 日；及
提出申請當日前 12 個月沒有離開英國超過 90 日。

所以在第 5 + 1 – 5 年，即時第 2 年開始計，直到第 6 年申請歸化，你不在英國的總日數不可超過 450 日，而在無限期居留這一年間，你不可離開英國超過 90 日。

因此，若你打算每 12 個月的時段離開英國 180 日，到 5 + 1 年後，你不在英國的總日會超過 450 日，會無法申請歸化成為英國公民。若此情況真的出現，你需要等到符合申請歸化的居住要求，即是在申請歸化前 5 年沒有離開英國超過 450 日，才可申請歸化入籍。
